U.S. law states that asylum may be granted to foreigners that can prove they have suffered past persecution and/or have a well-founded fear of future persecution based on their political opinion, race, religion, nationality, or membership in a specific social group if they were sent back to their home countries. At KEL Attorneys, we are dedicated to helping people escape persecution and find safe haven in the U.S. Asylum may be granted to people who are already in the United States, or to those just arriving. If you are already in the U.S., you or your attorney must file an I-589 form, which is the “Application for Asylum and for Withholding of Removal.” This form must be filed within a year of your arrival in the country regardless of whether you are residing here legally. There may be some scenarios where the one year bar can be exempt. If you are just arriving, you can ask for asylum at the port of entry (i.e. airport, seaport, border crossing, etc.). However, in order to be granted asylum, you must present substantial evidence that you were persecuted or at risk of persecution in your home country. You may apply for asylum by filing the application and initiating the process, or you may seek asylum as a defense to pending deportation proceedings. Proving that you experienced persecution or have a well-founded fear of future persecution can be very difficult, as most of the evidence remains back in your home country.
